On April 14, 2003, the privacy regulations promulgated by the Department of Health and Human Services (DHHS) under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) went into effect. In order to collect information necessary to prove their cases, plaintiff lawyers who litigate claims involving medical records must be familiar with HIPAA's privacy provisions to respond to defense and health-care-provider objections regarding the disclosure of protected health information. This litigation packet provides an overview of HIPAA and highlights the common HIPAA issues facing plaintiff lawyers.
The packet consists of
Statutory and DHHS materials;
AAJ Education speaker papers;
HIPAA authorization, compliance, and related litigation
materials.
This packet is designed to save AAJ members precious legal research
time and to serve as a valuable resource reference.
